Welcome to Family Palette. These Terms & Conditions govern your use of the Family Palette website and your purchase of products from Family Palette.
By accessing our website, placing an order, or purchasing a Family Palette product, you agree to these Terms & Conditions, along with our Return & Refund Policy and any other policies posted on our website.
If you do not agree with these terms, please do not use the website or place an order.
1. About Family Palette
Family Palette creates handcrafted watercolor palettes, travel watercolor kits, art supplies, artwork, and related products.
Many of our products are handmade from natural materials. Because of this, no two products will be exactly identical.
2. Handmade Products & Natural Variations
Family Palette products are individually handcrafted.
Wood grain, color, knots, figuring, mineral streaks, texture, and other natural characteristics may vary from one product to another. Small differences in dimensions, finish, epoxy, hardware placement, or other handmade characteristics may also occur.
These variations are part of the handmade nature of our products and are not considered defects.
Product photographs are intended to represent the product as accurately as possible. However, colors may appear differently depending on lighting, photography, screen settings, and the natural characteristics of the materials used.
When a product is identified as one-of-a-kind or the listing states that the item pictured is the exact item being sold, the customer will receive the specific item shown unless otherwise stated.
3. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, pricing, and other information are accurate.
Because our products are handmade, listed measurements may have minor variations.
We reserve the right to correct errors, inaccuracies, or omissions and to update product information at any time.
4. Pricing
All prices are displayed in U.S. dollars unless otherwise stated.
Prices may change at any time without notice.
The price charged for an order will be the price displayed at the time the order is submitted, except in the case of an obvious pricing or website error.
Applicable taxes and shipping charges will be calculated during checkout when required.
5. Orders
Submitting an order does not guarantee acceptance of that order.
Family Palette reserves the right to refuse, limit, or cancel an order for reasons including, but not limited to:
- Product availability
- Pricing or listing errors
- Suspected fraudulent activity
- Payment problems
- Shipping restrictions
- Unusually large order quantities
- Previous fraudulent or abusive transactions
If an order is canceled after payment has been collected, the appropriate amount will be refunded to the original payment method.
6. Payment
Payment must be successfully authorized before an order is processed.
By submitting payment information, you represent that you are authorized to use the payment method provided.
Customers are responsible for providing accurate billing, shipping, and contact information.
Family Palette is not responsible for delays or additional costs caused by incorrect information provided during checkout.
7. Fraud Prevention
Family Palette reserves the right to review orders for suspected fraud or unauthorized payment activity.
We may request additional information or verification before fulfilling an order.
Orders suspected of fraudulent activity may be canceled and refunded.
8. Shipping
Orders are shipped to the shipping address provided by the customer during checkout.
Customers are responsible for verifying that the shipping address is correct before submitting an order.
Once an order has been shipped, Family Palette may be unable to redirect or modify the shipment.
Estimated shipping and delivery dates are not guarantees. Carrier delays, weather, holidays, natural disasters, transportation disruptions, and other circumstances outside our control may affect delivery times.
9. Delivery Confirmation
Tracking information provided by the shipping carrier may be used as evidence that an order was shipped and delivered.
A package marked as delivered by the shipping carrier will generally be considered delivered to the address provided with the order.
If tracking indicates delivery but the package cannot be located, the customer should contact Family Palette as soon as possible so we can assist with determining the appropriate next steps.
Family Palette may require signature confirmation or other delivery verification for certain orders.
10. Returns, Refunds & Cancellations
Returns, refunds, exchanges, and cancellations are governed by the Family Palette Return & Refund Policy, which is incorporated into these Terms & Conditions.
Customers are responsible for reviewing the Return & Refund Policy before completing a purchase.
By placing an order, you acknowledge and agree to the Return & Refund Policy.
11. Custom & Personalized Products
Custom, personalized, engraved, commissioned, or specially manufactured products may not be eligible for return or cancellation.
Once work has begun on a custom or personalized order, the order may not be canceled unless otherwise agreed to by Family Palette.
Customers are responsible for reviewing and approving names, wording, artwork, instructions, or other personalization information they provide.
Family Palette is not responsible for errors resulting from incorrect information submitted by the customer.
12. Chargebacks & Payment Disputes
If there is a problem with an order, customers are encouraged to contact Family Palette before initiating a chargeback or payment dispute so we have an opportunity to investigate and resolve the issue.
Submitting a chargeback does not automatically cancel or override the terms of the purchase.
In response to a payment dispute, Family Palette may provide the payment processor, issuing bank, or other applicable financial institution with relevant transaction information, including:
- Order information
- Product descriptions
- Customer communications
- Shipping records
- Tracking information
- Delivery confirmation
- Applicable policies
- Evidence that the customer accepted or was presented with those policies
Nothing in these Terms & Conditions limits any rights a customer may have under applicable law or the rules governing their payment method.
13. Product Use
Family Palette products are intended for their ordinary artistic and creative purposes.
Customers are responsible for using products appropriately and according to any instructions provided.
Family Palette is not responsible for damage caused by misuse, improper storage, modification, neglect, exposure to inappropriate conditions, or use of a product for purposes for which it was not designed.
Because wood is a natural material, prolonged exposure to water, extreme heat, extreme cold, high humidity, or other harsh conditions may damage the product.
14. Children
Some Family Palette products or components may contain small parts or art materials that are not appropriate for unsupervised use by young children.
Parents and guardians are responsible for determining whether a product is appropriate for a child and for providing appropriate supervision.
15. Website Content & Intellectual Property
Unless otherwise stated, all content appearing on the Family Palette website is owned by or licensed to Family Palette.
This includes, but is not limited to:
- Product designs
- Product photographs
- Artwork
- Illustrations
- Logos
- Branding
- Written content
- Graphics
- Videos
- Product descriptions
- Website design elements
You may view and use the website for personal, non-commercial purposes.
You may not reproduce, copy, distribute, modify, sell, publish, commercially use, or create derivative works from Family Palette content without written permission.
Purchasing a physical product does not transfer ownership of any copyright, trademark, design, artwork, photograph, or other intellectual property associated with that product.
16. Reviews, Photos & Customer Content
If you voluntarily submit a review, photograph, testimonial, social media post, or other content directly to Family Palette for promotional use, you represent that you have the right to provide that content.
Family Palette will not claim ownership of your original content.
Any use of customer-provided content for advertising or promotional purposes will be subject to applicable law and any permissions provided by the customer.
17. Third-Party Services
Our website may use or link to third-party services such as payment processors, shipping carriers, social media platforms, or other websites.
Family Palette does not control these third-party services and is not responsible for their availability, content, privacy practices, policies, or actions.
Your use of third-party services may also be governed by their own terms and policies.
18. Website Availability
We make reasonable efforts to keep the Family Palette website operating correctly, but we do not guarantee uninterrupted or error-free access.
We may temporarily suspend, modify, or discontinue portions of the website for maintenance, updates, security, technical issues, or other business reasons.
19. Prohibited Use
You may not use the Family Palette website:

To the fullest extent permitted by applicable law, Family Palette will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our website or products.
To the fullest extent permitted by law, Family Palette’s total liability relating to a purchased product will not exceed the amount paid for the product giving rise to the claim.
These limitations do not apply where prohibited by law.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Family Palette from claims, damages, liabilities, or expenses resulting from your unlawful use of our website, violation of these Terms & Conditions, infringement of another person’s rights, or misuse of our products.
23. Governing Law
These Terms & Conditions and transactions with Family Palette will be governed by the laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable federal or consumer protection laws provide otherwise.

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect.
25. No Waiver
Failure by Family Palette to enforce any provision of these Terms & Conditions does not waive our right to enforce that provision in the future.

Family Palette may update these Terms & Conditions periodically.
Changes will become effective when the updated Terms & Conditions are posted on our website unless otherwise stated.
The version applicable to an order will generally be the version in effect when the order was placed.
